This ruling came in on Tuesday — in a case we filed many years ago. We didn’t start enforcing copyright yesterday. We’ve been documenting, striking, and building legal precedent for years. The consequences for infringement always come — sooner or later. And now, they’re here.

⚖️ The court’s final ruling (Sentencia No. 126/2025) leaves no doubt:

⚖️ “Se han reproducido 139 segundos, 3.268 fotogramas y 28 secuencias o fragmentos de las Obras infringidas.”
🟥 “A total of 139 seconds, 3,268 frames, and 28 sequences or fragments of the infringed Works were reproduced.”

It continues:

⚖️ “Ante la ausencia de acreditación de autorización de su uso, o cesión alguna de sus derechos, sí cabe deducir la aplicabilidad del TRLPI.”
🟥 “In the absence of any authorization or transfer of rights, the Spanish Intellectual Property Law clearly applies.”

The judge ordered Rafael Delgado Garcia to cease all unauthorized use and confirmed that damages are to be compensated. Every frame and second was ruled illegal. This isn’t speculation. This is precedent.


⛓️‍💥 The Fair Use Lie Is Over

To block our original takedowns, RDG filed six DMCA counter-notifications to YouTube, claiming “Fair Use under U.S. and European laws.

⚖️ That defense has now been rejected in a European court of law.

This ruling destroys the illusion of legitimacy. RDG’s “Fair Use” strategy was found to have no legal basis, making every future counter-notification a willful act of copyright infringement.

YouTube Must Act – Six Strikes, Final Channel Termination Pending

Following our valid DMCA takedown requests, YouTube placed six copyright strikes on RDG’s channel “The Finest.” These were put on hold due to counter-notifications that have now been legally deemed fraudulent.

⚖️ Now that the Spanish court has confirmed his liability, we have formally contacted YouTube to demand:

🟥 Immediate rejection of RDG’s counter-notices
🟥 Full restoration of our DMCA takedowns
🟥 Permanent termination of “The Finest” channel, as required by YouTube’s own policy

This is no longer a creator’s claim. It’s a court-backed demand for platform enforcement.

Although Rafael Delgado García claims to have special ways of recovering terminated YouTube channels, we’re curious to see if he can help himself now — after a court ruling confirmed copyright infringement. He stated:

DM me, my team and I have special connections where we can almost certainly bring any channel back to life, regardless of what the situation was or how long it was terminated for.

We are also preparing to publish carefully selected, redacted excerpts of RDG’s counter-notification texts — as part of a larger documentation series exposing the tactics used in copyright abuse at scale. Spoiler: these counter-notifications were submitted using repetitive, copy-paste templates — a tactic commonly used in automated copyright abuse.


👺 The Network Behind the Mask

We will continue to publish verified information about the shadow operation run by Rafael and Leonardo Delgado García, who together operate at least 15 confirmed YouTube channels. These channels generate millions of dollars in revenue per year (↗️Link), partly through the use of copied, unlicensed footage.

Their method is systematic:

🟥 Rip drone and travel footage from creators around the world
🟥 Edit into compilations or AI-narrated lists
🟥 Monetize under multiple separate YouTube accounts
🟥 Delay enforcement (often to surpass the 10-day DMCA threshold) using template counter-notifications and/or questionable legal threats
involving attorneys from Russia, Ukraine, or Brazil who allegedly represent U.S.-based operations

⚖️ These tactics are documented, timestamped, and prepared for court presentation.


Cease and Desist Letters Ignored

In recent weeks, we sent multiple formal Cease and Desist letters — to Rafael, but also to his brother Leonardo Delgado García. Neither of them responded. None of the infringements were removed. Not a single video was taken down. All evidence has been preserved in accordance with ISO 27037:2013 — the same evidentiary standard that already dismantled his defense once.

⚖️ This willful inaction only strengthens the case against them — in both civil court and, potentially, criminal court.


🔜 The Next Moves: We Are Just Getting Started

With this court ruling now in hand, we are initiating three major lawsuits:
